By accessing this website (hereinafter "Site") and the Pearson ePortfolio system (hereinafter "Services") contained on this Site, you agree you have read and understood these Terms and Conditions of Use (hereinafter "Terms of Use"). You acknowledge your use of this Site and its Services are subject to these Terms of Use and the Privacy Policy, and agree your use shall conform to these Terms of Use and Privacy Policy. By continuing to use this Site and its Services, you acknowledge that you understand, accept and agree to the terms of this Privacy Policy and the Terms of Use for this Site.

This Site and the Pearson ePortfolio system are licensed or owned and maintained by NCS Pearson, Inc. (hereinafter "Pearson"). These Terms of Use apply to personal information that Pearson may collect or process in providing test registration and testing services. Content created solely by Site users, not including any embedded content owned by any third parties, and submitted through this Site for review and scoring, shall remain the intellectual property of the individual that created such content. The Site and Pearson ePortfolio system and assessment related materials shall remain the intellectual property of Pearson, its licensors or Client, as applicable.

Purpose and Requirements. This site is intended to be used by higher education faculty and Candidates (defined below) as a source of information regarding the Massachusetts Performance Assessment for Leaders (hereinafter "PAL") and as an electronic portfolio or artifact submission system for candidates in connection with the PAL. Candidates fulfilling a requirement for an educator preparation program and/or certification ("Candidates") may use this Site to upload assessment materials and submit to Pearson for scoring. In order to purchase the Pearson ePortfolio services and register for PAL scoring, candidates will be required to provide their payment or credit card information, name, e-mail address, address, phone number, date of birth, gender (optional), partial Social Security number, and/or Massachusetts Education Personnel ID (MEPID), and other demographic information. Candidates will create a unique user name and password. Do not share your password with others. Pearson will provide authorized users with access to the site as required for completion of tasks assigned to such user.

Payment Methods and Transaction Terms. The fees for registering for the Massachusetts Performance Assessment for Leaders (PAL) services must be paid using a voucher and/or credit card (VISA or MasterCard only) or a debit or check card that carries the VISA or MasterCard logo and that can be used without the entry of a personal identification number (PIN). Bank cards without a VISA or MasterCard logo cannot be accepted. The merchant name that will appear on your credit card statement is "Eval Systems Test Fee." Information regarding refunds for withdrawal is available on the Withdrawal/Refund policy on the Massachusetts PAL website.

Acceptable Use of Site. You are granted, subject to these Terms of Use, a personal, non-exclusive, non-assignable, and non-transferable license to access and use the ePortfolio system and this Site in conjunction with the PAL for educational and non-commercial use only. Candidates will be required to purchase services before certain functionality on the Site is available for use. Modifications of any materials on this Site or use of the materials for any purpose other than as contemplated in this Site is a violation of Pearson's or third party copyright and proprietary rights. You agree not to reverse engineer, duplicate, publish, modify, or otherwise distribute the materials on this Site. You agree that you have all legal right, title, and interest to use and submit the PAL materials you upload to this Site. You agree that you have obtained appropriate authorization forms and releases required for portfolio or artifact content submitted or uploaded to this Site. You agree not to post or submit any content, comments, suggestions or questions to the Site or the ePortfolio system that 1) are illegal, obscene, threatening, defamatory, an infringement on the privacy or intellectual property rights of others, injurious to a third party or constitutes spam, political campaigning, commercial solicitation, a chain letter or a mass mailing or 2) contain any viruses or malware. Pearson reserves the right to remove, edit or report any such content or posting. Pearson is not obligated to review and monitor content posted to the Site nor is Pearson responsible for any User postings or submission.

Unlawful Use. As a condition of your use of this Site, you warrant to Pearson that you will not use this Site for any purpose that is unlawful or prohibited by the Terms of Use. You agree not to use this Site in any manner that could damage, disable, overburden, or impair this Site or its contents or interfere with any other party's use and enjoyment of this Site. You agree not to take any action that might compromise or penetrate the security of this Site or its contents. You agree not to obtain or attempt to obtain through this Site any materials or information not intentionally made available to you through this Site. You agree to immediately notify es-postmaster@pearson.com of any unauthorized use of your account or any breach of security.

When you register for the Services, you agree that Pearson may provide you with information about updates, products, and services related to PAL, and opportunities for participation in test-related studies or activities from time to time as described in the Privacy Policy.
